Commands On The Waiting Period For Widows Book Review
In the Name of Allah, the Merciful, the Beneficent
All praise belongs to Allah, Lord of the universe and Master of our fortunes, and may peace and blessings descend upon His beloved Prophet Muḥammad ﷺ, his companions and all those who follow in their footsteps. To proceed:
I have been requested to pen some comments on a book entitled Commands on the Waiting Period for Widows, authored by the daughter of one of the most learned scholars and gems of the UK, Shaykh al-Ḥadīth Mufti Umar Faruq Luharvi Ṣāḥib. Al-Ḥamdulillāh, I read the entire book and benefited a great deal. The book features all the key rulings pertaining to ʿIddat al-Wafāt with many practical examples and two flow charts at the end. It is a beneficial resource for scholars, students, and laypeople. It is clear, easy to follow and is fully referenced from the earlier sources as well as recent Fatwa books. The book also includes some contemporary scenarios, for example, the permissibility for a widow to attend the naturalisation interview during ʿIddah (p.16) and the permissibility to go for Hajj if paid for and a refund is not possible (p.32).
One of the edicts mentioned in the book (p.14) is that ʿIddah is complete if a miscarriage occurs four months into the pregnancy or thereafter. Our humble research is that although some ḥanafī jurists have mentioned this, the preferred view is that ʿIddāh is complete if the miscarriage occurs after the formation of some limbs, which occurs within 7-8 weeks of conception (9-10 weeks from the last menstrual period). Details are outlined in two of our answers entitled Bleeding during pregnancy and after miscarriage and Miscarriage at 100 days, which are available on our website. Two other minor points are mentioned for completion purposes. In relation to shopping, it may be worth adding that it is strongly advised for those in ʿIddāh to consider online shopping where feasible. Likewise, the prohibition of silk does not apply to artificial silk.
I pray to Allah Almighty to accept this publication, reward and bless the author and grant further tawfīq to produce similar works. A comprehensive guide to the jurisprudence of Ḥayḍ is much- needed task, if this can be worked upon, this would be of immense benefit.
